1.1 Who we are. These General Terms and Conditions (the "Terms") are a contract between you and The Woodlands Travel Club, LLC, a Texas limited liability company doing business as Suitcases & Savoir Faire Society (the "Society," "we," "us," or "our"). Our principal place of business is 26400 Kuykendahl Rd, STE C180-212, The Woodlands, TX 77375. "S&SF Society" is a short form of our assumed name.
1.2 What these Terms cover. These Terms apply to everyone who visits savoirfairetravelsociety.com, subscribes to our mailing list, joins our community channels, or attends a Society meeting or event, whether or not they are a Member.
1.3 What we are. The Society is a travel community. We host gatherings and promote group trips to our Members. We are not a travel agency, tour operator, or travel supplier, and we do not sell travel. Group trips are booked through our designated Travel Partner (see Section 6).
1.4 Acceptance. By using the Website, you agree to these Terms. By checking the acceptance box when you register or RSVP for a Society event, you agree to these Terms, including the Assumption of Risk and Release in Section 9. If you do not agree, do not use the Website or attend Society events.
1.5 IMPORTANT NOTICE. THESE TERMS INCLUDE AN ASSUMPTION OF RISK AND A RELEASE OF CLAIMS THAT INCLUDES CLAIMS ARISING FROM THE SOCIETY'S OWN NEGLIGENCE (SECTION 9), A LIMITATION OF LIABILITY (SECTION 10), AND AN INDEMNITY (SECTION 11). PLEASE READ THEM CAREFULLY.
1.6 Age. You must be at least 21 years old to register for or attend a Society event. The Website is not directed to anyone under 18.
"Website" means savoirfairetravelsociety.com and its pages, forms, and mailing-list sign-ups.
"Member" means a person who has purchased a membership and accepted the Membership Agreement, and the members of that person's Household as defined in the Membership Agreement.
"Guest" means anyone who is not a Member and who registers for or attends a Society meeting or event.
"Society Event" means any meeting, gathering, reception, social, presentation, or other in-person or virtual event the Society hosts or organizes. A Society Event does not include a Trip.
"Trip" means any group trip, cruise, tour, or travel experience promoted through the Society.
"Travel Partner" means the licensed travel agency or agencies the Society designates to book and sell Trips. Our current Travel Partner is Exemplary Travel Advisors, LLC.
"Membership Agreement" means the Suitcases & Savoir Faire Society Membership Agreement that Members accept at checkout.
"Trip Terms" means the trip-specific terms and conditions the Travel Partner issues for each Trip.
"Community Platforms" means the Member Portal, the Society's Facebook group, and any other community channel the Society operates.
3.1 Guests and visitors. If you are not a Member, these Terms and our Privacy Policy are the full agreement between you and the Society.
3.2 Members. If you are a Member, your membership is governed by the Membership Agreement. These Terms also apply to your use of the Website. If these Terms conflict with the Membership Agreement, the Membership Agreement controls.
3.3 Trips. Every Trip booking is governed by the Travel Partner's Trip Terms and the terms of the underlying travel suppliers. The Society is not a party to your booking contract. If anything in these Terms conflicts with the Trip Terms on a booking matter (payment, cancellation, refunds, changes, or travel documents), the Trip Terms control.
3.4 Other program terms. Some services, such as optional roommate matching, have their own terms, which you must accept separately before using them, if they are offered.
4.1 Becoming a Member. Membership is available by online purchase on the Website. Membership benefits, fees, automatic renewal, and cancellation are described in the Membership Agreement, which you must accept at checkout. Membership is open sign-up and is not subject to an application or approval process.
4.2 Guests are welcome at meetings. Through the Society's free tier, Guests may attend Society meetings and events that we designate as open to Guests. The free tier does not include Member benefits or the ability to book Trips. We may require Guests to register or RSVP in advance, limit attendance, or charge an event fee. Some events, including Member-only events and Member-only receptions on Trips, are not open to Guests.
4.3 Trips are for Members only. Guests may not book or travel on a Trip. To book a Trip, you must be a Member in good standing when you book and through the Trip's departure. Anyone who is not part of a Member's Household, including a person sharing a Member's room, must purchase their own membership before booking.
4.4 Trip previews. Trip descriptions on the Website are general previews, not offers to sell travel. Full trip details and priority booking are Member benefits. Information may change, and the Travel Partner's booking documents control.
4.5 No guarantee of attendance. We may decline, limit, or cancel any registration, and we may ask any person to leave a Society Event, at our discretion and consistent with applicable law.
4.6 Guests bound by these Terms. By registering for or attending a Society Event, a Guest agrees to the Code of Conduct (Section 8) and the Assumption of Risk and Release (Section 9). A Member who brings a Guest is responsible for that Guest's conduct.
5.1 Changes and cancellations. We may change the date, time, venue, format, speakers, or content of any Society Event, or cancel it, at any time. If we cancel a Society Event for which you paid an event fee, we will refund that fee. We are not responsible for travel, parking, childcare, or other costs you incur to attend.
5.2 Event fees. Unless an event listing says otherwise, any event fees remitted are refundable if you cancel at least [48] hours before the event.
5.3 Venues. Society Events are often held at restaurants, hotels, wineries, and other third-party venues. You must follow venue rules. Venues are independent businesses, and the Society is not responsible for their acts, omissions, food, beverages, premises, or services.
5.4 Food, beverages, and allergies. Food and drink at Society Events are prepared by venues or caterers, not by the Society. You are responsible for asking about ingredients and managing your own allergies and dietary needs.
5.5 Alcohol. Some Society Events serve alcohol. If you drink, do so lawfully and responsibly, and arrange safe transportation. The Society does not serve or sell alcohol and is not responsible for your decision to drink or to drive.
5.6 Presentations are informational. Speakers, travel advisors, and supplier representatives at Society Events share general information. It is not individualized travel, legal, medical, financial, or immigration advice. Any travel you choose to book with a speaker or supplier outside a Trip is between you and that business.
5.7 Virtual events. If we offer a virtual event, do not record, rebroadcast, or share it without our permission.
6.1 The Travel Partner sells and books Trips. All Trip bookings, deposits, payments, cancellations, changes, refunds, travel documents, and travel-related disputes are handled by the Travel Partner under its Trip Terms. Trip Terms for each Trip are available in the booking portal and must be reviewed and accepted before you pay a deposit.
6.2 THE SOCIETY IS NOT A SELLER OF TRAVEL. THE SOCIETY DOES NOT SELL, ISSUE, OR ARRANGE TRANSPORTATION, LODGING, OR OTHER TRAVEL SERVICES, AND IT DOES NOT ACCEPT PAYMENT FOR TRAVEL OR HOLD TRAVEL FUNDS. THE TRAVEL PARTNER IS THE SELLER OF TRAVEL. Exemplary Travel Advisors, LLC is registered as a seller of travel in California, Registration No. 2173352-70, and Florida, Registration No. ST14303, TI77293. The Travel Partner will provide its own seller of travel disclosures where required by law.
6.3 Relationship disclosure. The Society and Exemplary Travel Advisors, LLC are separate legal entities under common ownership and management. When a group Trip is booked through the Travel Partner, the Travel Partner pays the Society a referral fee equal to a small percentage of the commissions it earns on that booking. The fee helps cover the Society’s operating costs. The Travel Partner, not the Society, arranges all travel. The Society may change or add Travel Partners at any time.
6.4 Suppliers are independent. Airlines, cruise lines, hotels, tour operators, guides, and other suppliers are independent businesses. Neither the Society nor its Members are their agents, and the Society is not responsible for their acts or omissions.
6.5 Society-funded extras. Where a Trip includes a Member-only reception or other benefit paid for by the Society, it is a Member benefit provided by the Society, not a travel service sold to you. It may be changed or cancelled without a refund of any Trip price.
6.6 Your responsibilities. You are responsible for valid passports, visas, health requirements, and travel insurance. We strongly recommend comprehensive travel insurance, including cancellation, medical, and evacuation coverage, for every Trip.
7.1 Membership fees. Membership fees, automatic renewal, cancellation, and refunds are governed only by the Membership Agreement.
7.2 Event fees. Event fees are charged at registration and are governed by Section 5 and the event listing.
7.3 Trip payments. Payments for Trips are made to and governed by the Travel Partner. Do not send Trip payments to the Society.
7.4 Payment processing. Payments to the Society are processed by third-party payment processors. We do not store full payment card numbers. Prices are in U.S. dollars and exclude applicable taxes unless stated.
7.5 Chargebacks. If you have a billing concern, please contact us first at [email protected] so we can try to resolve it. We may suspend Website, event, or membership access while a chargeback is pending.
8.1 Who it applies to. Members follow the Code of Conduct in the Membership Agreement. Guests and anyone using the Website or Community Platforms agree to the standards in this Section.
8.2 Standards. You agree to:
Treat members, guests, hosts, venue and supplier staff, and the public with courtesy and respect. Harassment, threats, discrimination, and abusive conduct are not allowed.
Respect others' privacy. Do not share another attendee's personal information, photos, or private conversations without permission.
Follow venue rules, posted dress codes, and the reasonable instructions of Society hosts.
Drink lawfully and responsibly, and do not use illegal drugs at Society Events. Intoxication does not excuse a violation.
Not use Society Events, the Website, or Community Platforms to advertise or solicit for any business, product, or competing travel offering without our prior written permission.
Not conduct yourself in a way that unreasonably disrupts others' enjoyment, makes others feel unwelcome or unsafe, or harms the Society's relationships with venues, partners, or the community.
Pay for any damage you or your guests cause to venue property.
8.3 Enforcement. The Society decides in its sole discretion whether conduct violates this Section. We may, with or without warning, remove a person from a Society Event, cancel their registrations, exclude them from future Society Events and Community Platforms, and decline any future membership purchase. Event fees are not refunded after removal. A person excluded from the Society may not attend as any Member's guest without our prior written approval.
9.1 Who this Section applies to. This Section applies to every Guest who registers for or attends a Society Event. Members are bound by Section 9 of the Membership Agreement, which controls for Members.
9.2 ASSUMPTION OF RISK. IN-PERSON EVENTS INVOLVE INHERENT RISKS, INCLUDING ILLNESS, INJURY, OR DEATH; FOOD- AND ALCOHOL-RELATED RISKS; ACCIDENTS AND SLIP-AND-FALLS; TRAVEL TO AND FROM EVENTS; CRIME; LOST OR DAMAGED PROPERTY; THE CONDITION OF VENUES; AND THE CONDUCT OF OTHER ATTENDEES AND THIRD PARTIES. YOU VOLUNTARILY ASSUME ALL OF THESE RISKS.
9.3 RELEASE, INCLUDING THE SOCIETY'S OWN NEGLIGENCE. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE, WAIVE, AND DISCHARGE THE SOCIETY AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, HOSTS, AND AGENTS (THE "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, AND LIABILITIES FOR PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR FINANCIAL LOSS ARISING OUT OF OR RELATED TO YOUR ATTENDANCE AT OR PARTICIPATION IN ANY SOCIETY EVENT. THIS RELEASE APPLIES EVEN IF THE CLAIM IS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF ANY RELEASED PARTY. IT ALSO COVERS CLAIMS ARISING FROM THE CONDUCT OF OTHER ATTENDEES.
9.4 EXCLUSIONS. THIS RELEASE DOES NOT APPLY TO CLAIMS ARISING FROM A RELEASED PARTY'S GROSS NEGLIGENCE, FRAUD, OR INTENTIONAL OR WILLFUL MISCONDUCT, OR TO ANY CLAIM THAT CANNOT BE RELEASED UNDER APPLICABLE LAW.
9.5 WHO IS BOUND. THIS RELEASE BINDS YOU AND YOUR HEIRS, EXECUTORS, AND ESTATE.
9.6 How you accept. Guests accept this Section by checking an unchecked acceptance box in the event RSVP. A Guest who has not accepted it may not attend. The RSVP form shows the key terms of this Section in conspicuous text, and each adult attendee must accept them individually. Guests who arrive without an RSVP accept the same terms at check-in before entering.
10.1 DISCLAIMER. THE WEBSITE, COMMUNITY PLATFORMS, SOCIETY EVENTS, AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, THE SOCIETY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT TRIP INFORMATION, PRICES, OR AVAILABILITY SHOWN ON THE WEBSITE ARE CURRENT OR COMPLETE.
10.2 LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, AND EXCEPT FOR CLAIMS EXCLUDED UNDER SECTION 9.4, THE SOCIETY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS, THE WEBSITE, OR ANY SOCIETY EVENT IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO THE SOCIETY IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100. THE SOCIETY IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR LOST ENJOYMENT.
10.3 Members. For Members, Section 9.6 of the Membership Agreement controls the cap on the Society's liability for claims related to membership.
10.4 Trips. The Society has no liability for any Trip, which is sold by the Travel Partner and provided by independent suppliers. Your remedies for Trip-related claims are against the Travel Partner and suppliers under the Trip Terms.
INDEMNITY. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASED PARTIES FROM CLAIMS, LOSSES, AND REASONABLE ATTORNEY'S FEES BROUGHT BY THIRD PARTIES THAT ARISE FROM YOUR BREACH OF THESE TERMS, YOUR USE OF THE WEBSITE OR COMMUNITY PLATFORMS, CONTENT YOU POST, OR YOUR CONDUCT OR THE CONDUCT OF YOUR GUESTS AT ANY SOCIETY EVENT. THIS INDEMNITY DOES NOT COVER LOSSES CAUSED BY A RELEASED PARTY'S OWN NEGLIGENCE, GROSS NEGLIGENCE, OR INTENTIONAL MISCONDUCT.
12.1 Events are photographed. The Society and its designated photographers may photograph, film, or record Society Events.
12.2 Your consent. When you RSVP, you choose whether the Society may use photographs, video, and audio in which you are identifiable. If you choose yes, you grant the Society a non-exclusive, royalty-free, worldwide license to use them for the Society's website, newsletters, social media, and promotional materials, without compensation. We will not sell your image or license it to third parties for their own use.
12.3 Opting out. If you choose no, you will receive a wristband at check-in so our photographers can recognize your choice. You may change your choice at any time by telling the event host or emailing [email protected]. We will make reasonable efforts to avoid using images in which you are identifiable. If you later ask us to remove an image, we will stop using it in new materials within a reasonable time but are not required to recall materials already published.
12.4 Photographing others. Do not post photos or video of other attendees without their consent.
13.1 Permitted use. You may use the Website for your personal, non-commercial use. You may not copy, scrape, frame, or republish Website content; interfere with the Website's operation or security; attempt unauthorized access to the Member Portal; or use the Website for any unlawful purpose.
13.2 Our content. The Website's text, photos, graphics, logos, itineraries, and design, and the names "Suitcases & Savoir Faire Society" and "S&SF Society," are owned by or licensed to the Society and are protected by intellectual property laws. You may share links to Website pages. Any other use requires our written permission.
13.3 Content you submit. If you submit comments, reviews, suggestions, or other material through the Website or Community Platforms, you keep ownership of it. You grant the Society a non-exclusive, royalty-free, worldwide license to host, display, reproduce, and adapt it to operate the Community Platforms and promote the Society. You must have the right to share anything you submit. If you remove your content from the Community Platforms, we will stop using it in new promotional materials within a reasonable time but are not required to recall materials already published. We may remove any content at our discretion. Suggestions and feedback may be used without obligation to you.
13.4 Third-party sites. The Website links to third-party sites and services, including the Travel Partner, Facebook, payment processors, and suppliers. We do not control them and are not responsible for their content, privacy practices, or terms. Your use of Facebook is also subject to Meta's terms.
13.5 Copyright concerns. If you believe content on the Website infringes your copyright, email [email protected] with the details.
14.1 Privacy Policy. Our collection, use, and sharing of personal information, including through cookies, is described in our Privacy Policy at https://savoirfairetravelsociety.com/privacy, which is part of these Terms.
14.2 Sharing with the Travel Partner. If you register for a Society Event or request Trip information, we may share your contact information with the Travel Partner so it can respond to you, as described in the Privacy Policy.
14.3 Email. If you subscribe to our mailing list or register for an event, you agree to receive emails from us. You may unsubscribe from marketing emails at any time using the link in any email. Transactional messages about an event you registered for may still be sent.
14.4 Text messages. We send marketing text messages only to people who give separate, express consent. Consent is not a condition of any purchase or registration. Message and data rates may apply. Reply STOP to opt out at any time.
15.1 Talk to us first. If you have a concern, contact us at [email protected]. We will try in good faith to resolve it informally within 30 days.
15.2 Governing law. These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Mandatory consumer protection laws of your state of residence still apply where they cannot be waived.
15.3 Venue. Any lawsuit arising out of or relating to these Terms, the Website, or any Society Event must be brought in the state or federal courts located in Harris County, Texas, and you and the Society consent to their jurisdiction. Nothing in these Terms requires arbitration or waives the right to a jury trial.
15.4 Trip disputes. Disputes about a Trip booking are resolved under the Travel Partner's Trip Terms.
16.1 Changes to these Terms. We may update these Terms by posting a new version on the Website with a new "Last Updated" date. Changes apply from that date forward and do not apply to a Society Event you already attended. A change to Section 9 binds a Guest only after the Guest accepts it, such as at their next event registration. Changes affecting Members' rights under the Membership Agreement follow the notice rules in that agreement.
16.2 Severability. If any provision is found unenforceable, the rest of these Terms remain in effect, and the provision will be enforced to the maximum extent allowed.
16.3 No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
16.4 No agency. Nothing in these Terms creates a partnership, joint venture, agency, or fiduciary relationship between you and the Society.
16.5 Assignment. You may not assign your rights under these Terms. We may assign these Terms to a successor to our business.
16.6 Force majeure. We are not responsible for failing to hold or complete a Society Event because of events beyond our reasonable control, including weather, natural disasters, public health orders, civil unrest, or venue closure.
16.7 Survival. Sections 9, 10, 11, 12, 13, and 15 survive after you stop using the Website or attending Society Events.
16.8 Electronic acceptance. Your electronic acceptance of these Terms has the same effect as a handwritten signature.
